Terms of Service

SmartifyTrade is operated by SmartifyTrade Technologies Private Limited (CIN: U85500UW2026PTC254424), a company registered in India. By registering an account or using any part of the SmartifyTrade platform — accessible at smartifytrade.com (smartifytrade.in redirects here) — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.

These Terms apply to all users including Students, Guided Practitioners (GP), and Educators.

SmartifyTrade is a structured trading education platform. We provide:

• The STEP Workspace — a learning and analysis environment
• SmartifyTrade Bridge EA — a TradingView to MetaTrader 5 execution tool
• Student and Educator dashboards
• Educational content, frameworks, and community tools

SmartifyTrade is not a broker, investment advisor, portfolio manager, or SEBI-registered entity. Nothing on this platform constitutes financial advice, investment recommendations, or solicitation to trade.

4.1 Eligibility

You must be at least 18 years of age to register. By creating an account you confirm you meet this requirement.

4.2 Account Types

All users register as Students. Additional roles are available as follows:

• Guided Practitioner (GP) — available to all students via the referral tab from day one.
• Educator — requires a separate application and approval by SmartifyTrade. Approval is at our sole discretion.

4.3 Referral Commissions and Payments

To receive referral commissions or any other payments as a Guided Practitioner (GP) or Educator, you must be at least 18 years of age. You may update your age verification details in your profile at any time after registration. SmartifyTrade reserves the right to withhold commission payouts until age verification is complete.

4.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access at support@smartifytrade.com.

4.5 One Account Per User

Each person may hold one account. Creating multiple accounts is prohibited and may result in suspension of all associated accounts.

You agree not to:

• Use the platform for any unlawful purpose
• Share, sell, or distribute your account credentials or platform content
• Reverse-engineer, copy, or resell any part of the platform or SmartifyTrade EA
• Post or transmit harmful, abusive, or misleading content
• Impersonate SmartifyTrade, its staff, or other users
• Use automated tools to scrape or extract platform data
• Frame trading results as guaranteed, or solicit funds from other users

Educators accepted onto the platform agree to additional terms provided in the Educator Agreement, including:

• Content must be educational and must not constitute investment advice
• No solicitation of student funds or managed account arrangements
• Compliance with SmartifyTrade's conduct policy and communication standards
• SmartifyTrade retains the right to remove Educator status for policy violations

Commission and revenue-sharing arrangements are governed by the separate Educator Agreement signed at onboarding.

The SmartifyTrade Bridge EA is provided as a software tool for execution assistance only. Your licence to use the EA is personal, non-transferable, and limited to the tier purchased.

• The EA does not generate trading signals. It executes signals from TradingView strategies that you configure.
• You are solely responsible for the strategies you run and the risk settings you apply.
• Past backtests and hypothetical results shown in marketing materials do not guarantee future performance.
• Use on prop firm accounts is at your own risk. SmartifyTrade is not responsible for rule violations or account failures at third-party prop firms.
• SmartifyTrade does not select, recommend, or endorse any broker or prop firm. You choose which broker or prop firm account, if any, to connect the EA to, using your own credentials on infrastructure you control.
• You are solely responsible for ensuring that any funds you send to, or receive from, a broker or prop firm comply with the laws of your country of residence, including (for users in India) the Foreign Exchange Management Act (FEMA), RBI regulations, and the Liberalised Remittance Scheme (LRS). SmartifyTrade does not verify or take responsibility for the regulatory status of any third-party broker or prop firm.

Pricing for platform access and EA licences is shown at the time of purchase. All payments are processed via third-party payment providers.

• Fees are non-refundable except where required by applicable law or explicitly stated in a specific offer.
• Subscription cancellations take effect at the end of the current billing period.
• SmartifyTrade reserves the right to change pricing with reasonable notice.

8.1 Commission and Override Rates (GP, Educator, AP)

Referral commission, teaching-pool, and acquisition-override percentages payable to Guided Practitioners (GP), Educators, and Acquisition Partners (AP) — including any duration or time-based structure attached to them — are set at SmartifyTrade's sole discretion and are published on the relevant program page and/or partner agreement current at the time. These rates are subject to change from time to time; SmartifyTrade will provide reasonable notice of any change through the platform, partner dashboard, or email. The rate in effect on the date a qualifying subscription payment is processed applies to that payment; a rate change does not retroactively alter commissions already earned and payable for prior payments.

All content on SmartifyTrade — including the platform design, STEP framework, SmartifyTrade EA code, educational materials, and branding — is the intellectual property of SmartifyTrade and is protected by applicable copyright and trademark laws.

SmartifyTrade, SmartifyTrade Ecosystems, SmartifyTrade Academy, Limitify AI, and other product and brand names used across our platforms are brands and trademarks of SmartifyTrade Technologies Private Limited. References to "SmartifyTrade" in these Terms include all such brands operated by us, unless the context indicates otherwise.

You may not reproduce, distribute, or create derivative works from any platform content without prior written permission.

To the maximum extent permitted by applicable law, SmartifyTrade and its operators shall not be liable for:

• Any trading losses incurred while using the platform or SmartifyTrade EA
• Loss of profits, data, or business arising from use or inability to use the platform
• Actions of third parties including brokers, prop firms, or data providers
• Platform downtime, technical errors, or data inaccuracies

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

SmartifyTrade may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or cause harm to other users or the platform. You may delete your account at any time by contacting us.

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in India.

For users located in India, the Consumer Protection Act, 2019 and Information Technology Act, 2000 (as amended) also apply where relevant.

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance. We will notify registered users of material changes by email.

A Grievance Officer has been appointed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020 to receive and resolve user complaints. Every grievance is acknowledged within 48 hours and resolved within 30 days, as required under Indian law.
