1. Nature of Financial Markets Risk
Financial markets including equity, forex, commodities, indices, cryptocurrencies, and derivative instruments are inherently volatile. Prices can move rapidly and unpredictably due to economic events, geopolitical developments, market sentiment, liquidity conditions, and other factors beyond any individual's control.
You should be aware that:
- You can lose more than your initial investment when trading leveraged products such as futures, options, CFDs, or forex.

- Backtested and hypothetical results shown for educational purposes may not reflect real trading conditions including slippage, fees, latency, and liquidity constraints.

2. SmartifyTrade EA — Execution Tool Risk
The SmartifyTrade Bridge EA is an execution tool that automates trade placement based on signals generated by TradingView strategies you configure. It is not a trading system or signal service. By using the EA:
- You acknowledge that the EA executes your configured strategy automatically and that all strategy parameters, risk settings, and position sizing are your sole responsibility.
- Technical failures including server outages, internet connectivity issues, broker downtime, or software errors may cause missed executions, duplicate orders, or unintended positions.
- Use of the EA on prop firm, challenge, or funded account structures is entirely at your own risk. SmartifyTrade is not liable for account violations, drawdown breaches, or disqualifications arising from EA use on such accounts.
- Backtested performance of any TradingView strategy does not reflect live trading performance.
3. Educational Content — Not Financial Advice
All content on SmartifyTrade — including courses, frameworks, chart analysis examples, live sessions by educators, AI-assisted learning (Kuku, Aakruti), and community discussions — is provided strictly for educational purposes.
- No content on this platform should be interpreted as a recommendation to buy, sell, or hold any financial instrument.
- Educators on this platform are independent practitioners sharing educational content. Their views do not represent the position of SmartifyTrade and do not constitute investment advice.
- SmartifyTrade does not verify the accuracy of market views, trade ideas, or analysis shared by educators or community members.
4. No Signal Service or Copy Trading
SmartifyTrade does not provide a signal service, copy trading facility, or any mechanism where you automatically follow another person's trades. Any trading you do based on educational content viewed on this platform is a decision made solely by you.

5. Leverage and Margin Risk
Many of the instruments discussed on this platform can be traded with leverage. Leverage amplifies both gains and losses. A small adverse price movement in a leveraged position can result in losses exceeding your deposited margin, and in some cases, you may be required to deposit additional funds at short notice to maintain your position. If you are unable to meet a margin call, your broker may close your positions at a loss without prior notice.
Before trading leveraged products, ensure you fully understand how leverage works and that you are willing to accept the associated risk.
6. Prop Firm and Challenge Account Risk
SmartifyTrade education covers concepts that may be applied to prop firm evaluations and funded accounts. You acknowledge that:
- Prop firms set their own rules regarding maximum drawdown, daily loss limits, restricted instruments, news trading restrictions, and EA use policies.
- Violating a prop firm's rules may result in immediate disqualification and loss of your evaluation fee with no refund.
- SmartifyTrade has no affiliation with any specific prop firm and cannot guarantee compliance between our educational strategies and any prop firm's rules.
- Challenge fees paid to prop firms are non-refundable in most cases and should be considered at-risk capital.
7. Cross-Border Funds and Regulatory Compliance
SmartifyTrade is an education and software-tooling platform. We do not open, operate, recommend, endorse, or facilitate any account with any broker, prop trading firm, or financial intermediary, foreign or domestic. Any broker, prop firm, or trading platform you choose to connect the SmartifyTrade EA to is selected entirely by you, using your own credentials, on infrastructure you control.
- You are solely responsible for ensuring that any funds you send to, or receive from, a broker, prop firm, or trading platform comply with the Foreign Exchange Management Act (FEMA), RBI regulations, the Liberalised Remittance Scheme (LRS), and any other law applicable to you in your country of residence.
- SmartifyTrade does not verify, audit, or take any responsibility for the regulatory status of any broker or prop firm you choose to use. Publishing compatibility information (such as drawdown or consistency rules for a named prop firm) is provided for educational configuration purposes only and does not constitute an endorsement or recommendation of that firm.
- If you are unsure whether sending funds to a specific broker or prop firm is compliant with the law in your country, you must seek independent legal or regulatory advice before proceeding. Do not rely on SmartifyTrade, its educators, or its support staff for this determination.
- SmartifyTrade reserves the right to restrict, suspend, or decline to support EA connectivity to any specific broker or firm at its sole discretion, at any time, without liability.
8. Technology Risk
Using technology-dependent tools for trading introduces additional risks beyond market risk:
- Connectivity failures — loss of internet, VPS outages, or broker platform downtime can prevent execution of trades or prevent timely exit from positions.
- Software errors — bugs, unexpected behaviour, or version incompatibilities in the SmartifyTrade EA or your broker's MT5 terminal may cause errors.
- Data feed issues — incorrect price data from TradingView, your broker, or data providers can trigger incorrect signals.
You should have manual risk management procedures in place independent of any automated system.
9. Suitability
Trading financial markets may not be suitable for all persons. Before trading with real capital, you should carefully consider:
- Your financial situation and whether you can afford to sustain a total loss of the capital you intend to trade with.
- Your level of experience and knowledge of financial markets and the specific instruments you intend to trade.
- Your risk tolerance and emotional ability to handle large drawdowns without making impulsive decisions.

10. No Guarantee of Results
SmartifyTrade makes no representation or warranty that:
- Users who complete our courses or use our tools will be profitable traders.
- Any strategy, framework, or methodology taught on this platform will perform profitably in live market conditions.
- The SmartifyTrade EA will execute trades without error or achieve any specific outcome.
All educational content is provided on an "as-is" basis without any guarantee of trading performance.
11. Regulatory Status
SmartifyTrade is an educational technology platform. We are not registered with SEBI (Securities and Exchange Board of India), RBI, or any other financial regulatory authority as an investment advisor, broker, or asset manager. We operate strictly as an educational service provider.
